This article assesses the role of Immanuel Kant’s ideas in the historical philosophy of Gustav Shpet (1879—1937). This theme has been largely ignored by Shpet scholars who have concentrated on comparing his logical-methodological theories with the ideas of representatives of phenomenology (E. Husserl, R. Ingarden and others) and hermeneutics (F. Schleiermacher, W. Dilthey, H. Lipps, H.-G. Gadamer and others). Accordingly, the authors consistently reconstruct “the sphere of conversation” within which Shpet’s concept of “historical philosophy” was formed and reveal the place (...) and role of Kant’s ideas in Shpet’s theories (with particular focus on the Plato-Kant antithesis). Among Shpet’s “interlocutors” with whom he discusses Kant and thus “ploughs” the field of historical philosophy are G. I. Chelpanov and E. Husserl, B. Bolzano and A. Trendelenburg, F. Heman and M. Frischeisen-Kohler. We have attached Shpet’s notes on Kant in the archive of his family. Shpet’s attitude to Kant was controversial (while of course largely critical) and yet he was aware that Kant was the foundation of European philosophy and that his efforts to resolve the epistemological problem merit a second, thorough examination and a retracing of the path followed by Kant. The authors show that Shpet’s notes on Kant have more than historical-philosophical relevance. They enable us to take a new look at many theoretical and cognitive problems and, even more importantly, make us rethink the fundamental tenets of philosophy and the methodology of scientific cognition. We present a cross-sectional study of ethical decision-making correlated with spirituality and utilizing moral intensity as a moderator for workers in the Southeastern United States. This study presents spirituality as an individual variable and moral intensity as a situational variable along with ethical decision-making to examine the interaction of these factors in moral dilemmas. Utilizing previously validated instruments for ethical decision-making and individual spirituality, we find that workers with relatively high measured spirituality made less ethical decisions compared to workers with (...) relatively lower measures of spirituality. Further, we find that the introduction of high moral intensity as a situational variable does not moderate the observed correlation between spirituality and ethical decision-making. This research supports the conceptual nature of the Interactionist Theory by presenting in a single study both individual and situational variables in ethical decision-making. (shrink)

Provability, Computability and Reflection.

ABSTRACTThere are two distinct types of legal wrongdoing: civil and criminal. This article demonstrates in three ways that Immanuel Kant's Universal Principle of Right, properly interpreted, offers a plausible and resilient account of this important distinction. First, Kant's principle correctly identifies attempted crimes as crimes themselves even when they do not violate the rights of any individual. Second, it justifies our treatment of reckless endangerment as a crime by distinguishing it from ordinary negligence, traditionally thought to be only civilly wrong. (...) Third, it explains and justifies differences between the features of traditional criminal punishments and the features of civil remedies. Moreover, the Universal Principle of Right yields a Kantian standard for criminal wrongdoing that is compelling enough to inform future philosophical inquiries into the nature and limits of the state's criminal lawmaking authority. The paper consists of a reflexive exercise in which Herbert Simon 's views concerning science are applied to his own research. It argues that what connected his ventures into so many different disciplinary domains was a search for complex, hierarchical systems. In the process, the paper establishes a close connection between Simon 's insights and his focus on simulation. Instead of simulating Simon on a computer, though, it simulates Simon on paper. This exercise is then contrasted with Simon 's own (...) attempts to simulate science. This comparison leads to a reflexive evaluation of Simon 's simulations. (shrink)

This essay, as the title suggests, is not just a reply to Richard Ashcraft -- although it is certainly that too. Its intention is to say something about the political theory of Locke, about his historical context and about the methodological question of contexts in general. About his political theory, I want to make two or three main points which, I think, have important consequences for our understanding of Locke: that he both appropriates and, on critical issues, deliberately neutralizes the (...) radical �discourses� of his time -- so that, for example, he adopts Leveller premises to arrive at something more like Cromwell's (or even more conservative) conclusions; and that he deprives these radical discourses of their most democratic implications less by excluding people from membership in the political nation than by restricting the rights of membership itself. This means, among other things, that the relevant debate is not the one that has so preoccupied Locke scholars -- namely, the controversy about who is a �freeman� or who belongs to the �people�. The decisive question is rather what political rights the �people� have. (shrink)

A longstanding open problem of Keisler asks when T 2 is more complex than T 1 , as measured by the fact that for any such λ, ������, if the ultrapower (M 2 ) λ /������ realizes all types over sets of size ≤ λ, then so must the ultrapower (M 1 ) λ /������. In this paper, building on the author's prior work [12] [13] [14], we show that the relative complexity of first-order theories in Keisler's sense is reflected in the relative graph-theoretic complexity of sequences of hypergraphs associated to formulas of the theory. After reviewing prior work on Keisler's order, we present the new construction in the context of ultrapowers, give various applications to the open question of the unstable classification, and investigate the interaction between theories and regularizing sets. We show that there is a minimum unstable theory, a minimum TP 2 theory, and that maximality is implied by the density of certain graph edges (between components arising from Szemerédi-regular decompositions) remaining bounded away from 0, 1. We also introduce and discuss flexible ultrafilters, a relevant class of regular ultrafilters which reflect the sensitivity of certain unstable (non low) theories to the sizes of regularizing sets, and prove that any ultrafilter which saturates the minimal TP 2 theory is flexible. If it is true, as suggested by Sir Michael Marmot and other researchers, that status impacts health and therefore accounts for some of the social gradient in health, then it seems to be the case that it would be possible to bring about more equality in health by equalizing status. The purpose of this article is to analyze this suggestion. First, we suggest a working definition of what status precisely is. Second, following a luck egalitarian approach to distributive justice, we (...) consider whether and to which extent individuals are responsible themselves for their position in a status hierarchy. Third, we consider the contours of a difficult question, namely which political measures are feasible in order to reduce health-affective inequalities in status and fourth, whether or to what extent such measures are legitimate. We argue that on the basis of these considerations, we have at least some prima facie reasons to counter (at least some) status inequalities in order to equalize health. (shrink)

Background and objectives: Physicians are exposed to matters of existential character at work, but little is known about the personal impact of such issues. Methods: To explore how physicians experience and cope with existential aspects of their clinical work and how such experiences affect their professional identities, a qualitative study using individual semistructured interviews has analysed accounts of their experiences related to coping with such challenges. Analysis was by systematic text condensation. The purposeful sample comprised 10 physicians (including three women), (...) aged 33–66 years, residents or specialists in cardiology or cardiothoracic surgery, working in a university hospital with 24-hour emergency service and one general practitioner. Results: Participants described a process by which they were able to develop a capacity for coping with the existential challenges at work. After episodes perceived as shocking or horrible earlier in their career, they at present said that they could deal with death and mostly keep it at a distance. Vulnerability was closely linked to professional responsibility and identity, perceived as a burden to be handled. These demands were balanced by an experience of meaning related to their job, connected to making a difference in their patients’ lives. Belonging to a community of their fellows was a presupposition for coping with the loneliness and powerlessness related to their vulnerable professional position. Conclusions: Physicians’ vulnerability facing life and death has been underestimated. Belonging to caring communities may assist growth and coping on exposure to existential aspects of clinical work and developing a professional identity. (shrink)
